    House committee substitute makes the following changes to the 1st edition.

    Amends new GS 15A-1340.16(e)(14a), which establishes that suffering from Post Traumatic Stress Disorder (PTSD) is a mitigating factor, by providing that PTSD is as defined in the Diagnostic and Statistical Manual of Mental Disorders fifth edition (DSM-5) or subsequent editions that are published by the American Psychiatric Association (previously, did not include reference to subsequent editions of the DSM). Also amends documentary evidence requirements which are to be submitted to the court to verify military service and PTSD diagnosis, now requiring that proof of the specified required military service must consist of a certification by the Secretary of Military and Veterans Affairs (previously, required certification by the Director of the Department of Veterans Affairs).

    Amends GS 15A-1340.16(e) concerning aggravated and mitigated sentences, enacting new subdivision (14a), which provides that it is a mitigating factor that the defendant has been diagnosed as suffering from posttraumatic stress disorder (PTSD) as a result of his or her military service and is undergoing treatment for that condition. Sets out and defines PTSD for use in this section. Requires documentary evidence to be submitted to the court to verify military service and PTSD diagnosis. Effective October 1, 2016.

    Appropriates from the General Fund to the NC Military Affairs Commission $25,000 for the 2016-17 fiscal year to help support the State's Veterans Treatment Court. Effective July 1, 2016.
