    AN ACT TO REPEAL THE ANNEXATION OF CERTAIN DESCRIBED TERRITORY INTO THE TOWN OF YANCEYVILLE PRIOR TO THE EFFECTIVE DATE OF THAT ANNEXATION, TO REMOVE CERTAIN DESCRIBED PROPERTY FROM THE CORPORATE LIMITS OF THE CITY OF GREENSBORO, AND TO REVISE THE MCDOWELL COUNTY BOARD OF EDUCATION DISTRICTS. SL 2019-234. Enacted October 31, 2019. Effective October 31, 2019, except as otherwise provided.

    Conference report to the 2nd edition makes the following changes.

    Removes the described parcel from the City of Greensboro’s corporate limits. Provides a savings clause for property tax liens held by the City before the effective date of the act. Effective June 30, 2020. Declares property in the described parcel as of January 1, 2020, no longer subject to municipal taxes for taxes imposed for taxable years beginning on or after July 1, 2020.

    Amends SL 1987-322 regarding elections of the McDowell County Board of Elections and Board of Education. Makes the existing provisions in Section 3 that are currently applicable to the Board of Elections instead applicable to the Board of Education, with members serving four-year terms. Provides for the election of Board of Education members from elementary attendance zones beginning in 2020 and 2022, as specified, notwithstanding the merger plan for the Marion City Board of Education and McDowell County Board of Education. Sets out residency requirements and related administrative provisions.

    Makes conforming changes to the act's titles.

    Senate committee substitute deletes the provisions of the 1st edition and now provides the following.

    Repeals Section 2 of SL 2019-160, which annexed certain described property into the corporate limits of the Town of Yanceyville. The annexation was to become effective June 30, 2020.

    Amends the Charter for the Town of Walkertown, found in SL 1983-936, by adding a new Section 10.1, which provides as follows. 

    Empowers the Town Council, by ordinance, to regulate the uses of buildings and structures for trade, industry, residence, recreation, public activities, or other purposes, and the uses of land for trade, industry, residence, recreation, agriculture, water supply conservation, soil conservation, forestry, or other purposes. Allows dividing the Town's territorial jurisdiction into districts and allows for the regulation and restriction of  the erection, construction, reconstruction, alteration, repair, or use of buildings, structures, or land within those districts. Specifies additional requirements for such regulations. Also allows for the creation of special use districts in addition to general use districts. Sets out the requirements for a person petitioning for rezoning of a tract of land where special use districts are authorized. Sets out additional requirements depending on whether the petition is for general use district zoning or special use district zoning. Specifies what conditions may be included in a special use permit issued by the Town Council.  States that it is the intent of the new section to permit the creation of districts for specific uses and the imposition of reasonable conditions in order to secure the public health, safety, and welfare, and ensure that substantial justice be done.
